Terms of Use
These terms govern your use of Yestra. By creating an account you agree to them. If you use Yestra on behalf of a company, you confirm you may bind that company.
1. The service
Yestra is a workspace operated by Christos Alexis Fantino, an individual in Switzerland (“we”). Brands publish content missions: a brief, suggested hooks, assets, a deadline and what they will pay. Creators claim a mission, make a video, submit it for the brand's approval, publish it on their own TikTok account, and are paid by the brand according to the mission's terms. Yestra provides the tools: briefs, an editor, a creative assistant, review, performance tracking and a record of what is owed.
2. Eligibility
You must be at least 18 and able to enter into a contract. Creators must hold their own TikTok account in good standing and comply with TikTok's terms and community guidelines.
3. Your account
Keep your sign-in secure and your details accurate. You are responsible for what happens under your account. One person, one creator account.
4. Missions and the agreement they create
When a creator claims a mission, the mission's terms as shown at that moment — brief, deadline, base compensation, bonuses — form an agreement between that creator and that brand. Yestra is not a party to it, is not the employer or agent of either side, and does not guarantee that a submission will be approved or that a brand will pay. A brand may approve a submission or ask for changes, and must give a reason when it asks for changes.
5. Creators' content
- You keep ownership of the videos you make.
- By submitting a video to a mission you grant the brand a worldwide, non-exclusive, royalty-free licence to view and review it; once it is approved, to repost, share and reference it, including in its own marketing, for as long as the video is public on your account and twelve months after. A mission may state different usage terms, which then apply.
- You grant us the licence needed to store, process and display your submission inside Yestra.
- You confirm that the video is your own work, that you have the rights to everything in it (music, footage, people who appear), and that it does not infringe anyone's rights.
- You must disclose the commercial relationship on every video made for a mission, using TikTok's paid-partnership / commercial-content setting and as the law where you live requires. If a video is substantially AI-generated, label it as TikTok requires.
- Brand assets provided with a mission may be used only for that mission.
6. Compensation
- Base compensation becomes owed when the mission says it does — on approval, or on publishing.
- Performance bonuses are calculated from the video's public view count as read from TikTok through the connection you authorised, or, where no connection exists, from the public post. The figure Yestra reads is the one that counts.
- Artificial engagement voids bonuses. Bought views, bots, engagement pods, or any manipulation of a video's figures cancels the bonuses for that video and may end your account.
- If a video is deleted, made private, or removed by TikTok within 30 days of publishing, bonuses for it stop accruing and unpaid bonuses may be cancelled.
- Brands pay creators directly. Yestra records what is owed and what a brand marks as paid; it does not hold, move or guarantee money. Disputes about payment are between the creator and the brand, though we will share the records we hold with both.
- You are responsible for your own taxes, invoices and social-security obligations. Creators act as independent contractors.
7. Connecting TikTok
Connecting is optional and read-only; what is read and why is set out in the Privacy Policy. You may disconnect at any time. Yestra depends on TikTok's services: if TikTok changes or withdraws access, some features may stop working, and performance will then be read from the public post where possible.
8. The Creative Assistant
The assistant suggests hooks, scripts and filming advice using artificial intelligence. Its output can be wrong, generic, or similar to what it gives others. You decide what to use and are responsible for what you publish.
9. Acceptable use
Do not use Yestra to publish or request content that is unlawful, deceptive, hateful, sexual, or that makes health, financial or earnings claims that cannot be substantiated; do not upload malware, scrape the service, attempt to access other people's data, or use it to contact people outside the missions they take part in. Brands must not ask creators to hide a commercial relationship or to post misleading claims.
10. Intellectual property
Yestra, its software and its design belong to us. Brand names, logos and assets belong to the brands. Nothing here transfers ownership of any of it.
11. Availability and changes
Yestra is in early development. Features may change, be limited to invited users, or be withdrawn, and the service may be unavailable from time to time. We will give reasonable notice of changes that affect missions already claimed.
12. Ending
You may stop using Yestra and ask for your account to be deleted at any time. We may suspend or close an account that breaks these terms. Amounts a brand already owes a creator for approved work remain owed.
13. Disclaimer of warranties
Yestra is provided “as is” and “as available”, without warranties of any kind to the extent the law allows. We do not promise that a video will perform, that a mission will lead to earnings, or that figures read from third parties are free of error.
14. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential loss, lost profits, or loss arising from the acts of a brand, a creator or TikTok. Our total liability to you in any twelve-month period is limited to the greater of CHF 100 or the fees you paid us in that period. Nothing in these terms limits liability for intent or gross negligence, or any liability that cannot be limited under Swiss law.
15. Governing law
These terms are governed by Swiss law, excluding its conflict-of-law rules. The courts at the operator's domicile in Switzerland have jurisdiction, without prejudice to mandatory consumer-protection rules of the country where you live.
16. Changes to these terms
We may update these terms. We will tell you in Yestra before a material change takes effect; continuing to use Yestra after that date means you accept it. Questions: legal.aveldo@hotmail.com.
